“What the employer is doing is trying to walk the line between protecting the employee who is struggling with a mental illness. They’re trying not to do anything that would subject the employer to a violation of the ADA,” Ellen Storch, a partner at Kaufman Dolowich Voluk, told CorpCounsel.com. “On the other hand, the employer does not want to have to face a lawsuit for negligent retention.”
